Terms of Service

1. Acceptance of Terms
By creating an account on The AI Check ("AIC," "we," "us," or "our"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not create an account or use the Service.
Your acceptance is recorded at the time of account registration, including the timestamp and IP address of your acceptance. You must be at least 18 years of age to create an account or use the Service. If you are under 18, you may not register for or use the Service.
We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days before the changes take effect (see Section 15). Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service before they take effect.
2. Description of Service
The AI Check is an encrypted personal AI chat archive. AIC allows you to capture, encrypt, store, search, and export your conversation history from supported AI platforms — including Google Gemini, OpenAI ChatGPT, Anthropic Claude, and xAI Grok — in a single privacy-first vault.
AIC is not an AI provider. AIC does not generate AI responses on your behalf except when you use the Bring Your Own Key ("BYOK") feature with your own API keys (see Section 4). AIC does not have access to the content of your archived conversations.
The Service relies on the Universal Bridge Chrome extension ("Extension") to import your existing AI chat history from your own authenticated sessions on supported platforms.
3. Zero-Knowledge Architecture
AIC operates under a zero-knowledge encryption model we call the Zurich Protocol. This means:
- Your content is encrypted on your device using AES-GCM-256 encryption before it is transmitted to our servers.
- AIC stores only ciphertext. AIC staff cannot read, access, or view your archived content under any circumstance.
- AIC cannot recover your data if you lose your encryption key. There is no "forgot password" reset for your vault content. If you lose your master encryption key, your archived data is permanently and irreversibly inaccessible. You acknowledge and accept this risk by using the Service.
- In the event of a data breach of AIC's servers, compromised data consists of ciphertext that is meaningless without your encryption key, which AIC does not hold.
- If AIC receives a valid legal process request (such as a subpoena or court order), AIC can only produce ciphertext. AIC will comply with valid legal process by providing available data, but that data is encrypted and AIC does not possess the decryption key.
4. Bring Your Own Key (BYOK)
AIC offers a BYOK feature that allows you to use your own API keys from third-party AI providers (such as OpenAI, Google, Anthropic, or xAI) to generate AI responses within the AIC dashboard.
- Your API keys are encrypted on your device with your master encryption key before storage. AIC stores only the encrypted form of your keys and cannot access, read, or use them.
- You are solely responsible for complying with the terms of service of each AI provider whose API key you supply.
- API usage costs are billed directly by the AI provider to you. AIC is not a reseller of AI services and does not charge for or subsidize your API usage.
- AIC is not liable for any API costs you incur through the BYOK feature, including costs resulting from unauthorized use of your API keys if your AIC account or device is compromised.
- You must not input API keys belonging to third parties without the key owner's explicit authorization.
5. Extension and Scraping Terms
The Universal Bridge Extension operates exclusively on AI platforms where you hold an active, authenticated account. When you use the Extension, you are importing your own conversation history — not content belonging to third parties.
- You are responsible for ensuring that your use of the Extension complies with the terms of service of each AI platform. AIC recommends that you review each platform's terms before using the Extension.
- AIC does not warrant that the Extension will continue to function if AI platforms change their user interfaces, APIs, or terms of service.
- AIC does not encourage or endorse any activity that violates the terms of service of any AI platform. AIC is not a party to your agreements with those platforms.
- The Extension is designed for individual personal use. Automated, high-volume, or systematic scraping that could burden AI platform infrastructure is prohibited (see our Acceptable Use Policy).
- AIC reserves the right to throttle, rate-limit, or suspend accounts that disproportionately consume system resources (including but not limited to database operations, serverless function invocations, or bandwidth) in a manner that degrades the Service for other users.
6. Accounts and Security
You are responsible for maintaining the confidentiality of your account password and your master encryption key. You agree to:
- Use a strong, unique password for your AIC account.
- Safeguard your master encryption key (including any Recovery Kit you generate). AIC cannot reset or recover your encryption key.
- Notify AIC immediately at [email protected] if you suspect unauthorized access to your account.
AIC will not be liable for any losses or damages arising from unauthorized access to your account resulting from your failure to maintain account security.
7. Subscription and Payment
AIC offers the following tiers:
- Free: Limited functionality at no cost.
- Pro: $20 per month or $200 per year. Full access to all features.
- Enterprise: Custom pricing. Contact us for details.
Billing is handled by Stripe. AIC does not store your payment card numbers. Pro subscriptions renew automatically at the end of each billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period.
No refunds are provided for partial billing periods, except where required by applicable law. AIC reserves the right to change pricing with at least 30 days' notice. Price changes do not apply retroactively to the current billing period.
8. Data Deletion and Key Loss
You may delete your account at any time through the dashboard. Account deletion triggers:
- Cryptographic erasure: AIC deletes your encrypted vault data and any key material AIC holds (such as wrapped encryption keys). This is immediate and irreversible.
- Account data removal: Your account metadata (email, profile, billing references) is deleted within 30 days, except where retention is required by law (e.g., financial records).
Key loss: If you lose your master encryption key and have not generated a Recovery Kit, your encrypted data is permanently inaccessible. AIC cannot recover it. There are no exceptions to this policy. This is a fundamental consequence of the zero-knowledge architecture, not a limitation we can override.
9. Indemnification
You agree to defend, indemnify, and hold harmless AIC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your violation of these Terms or the Acceptable Use Policy.
- Your violation of any third-party right, including any intellectual property right or terms of service of any AI platform.
- Your use of the Extension or BYOK feature in a manner that results in a third-party claim against AIC.
- Any content you store, transmit, or process through the Service that violates applicable law.
10. Prohibited Uses
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of the Acceptable Use Policy may result in warning, suspension, or permanent termination of your account.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, AIC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, AIC does not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- Any particular AI platform will remain compatible with the Universal Bridge Extension, including in the event that a platform permanently blocks the Extension's scraping mechanism.
- Your encrypted data will remain accessible if you lose your encryption key.
- The Service will remain functional with respect to any specific AI platform. If a third-party platform permanently prevents the Extension from operating, no refunds, credits, or damages are owed.
AIC warrants that the Zurich Protocol encryption is implemented as described in Section 3, but makes no warranty regarding the security of your device, password, or network environment.
12. Limitation of Liability
To the maximum extent permitted by applicable law, AIC's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service is limited to the greater of: (a) the amount you have paid to AIC in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).
AIC is not liable for:
- Loss of encrypted data due to loss of your encryption key.
- Loss of Service functionality due to changes made by AI platforms to their interfaces or terms.
- API costs incurred through the BYOK feature.
- Any indirect, incidental, special, consequential, or punitive damages, regardless of the theory of liability.
13. Enterprise Terms
Enterprise customers are subject to a separate Master Services Agreement ("MSA") and may execute a Data Processing Agreement ("DPA") as required by applicable law. In the event of any conflict between these Terms and an executed MSA, the MSA governs for that enterprise customer.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved through good-faith negotiation shall be submitted to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.
If you are a resident of the European Union or United Kingdom, nothing in this section limits your right to bring proceedings in the courts of your country of residence where such rights cannot be waived by contract.
15. Changes to These Terms
We may modify these Terms at any time. If we make material changes (as defined in our policy update procedures), we will provide at least 30 days' notice via email and an in-app notification before the changes take effect.
For material changes to these Terms of Service, you will be required to affirmatively accept the updated Terms on your next login after the effective date. If you do not accept the updated Terms, your account will remain intact but you will not be able to access the Service until you accept.
Non-material changes (such as formatting corrections or clarifications that do not alter your rights or obligations) may be made without notice.
